Plagiarism is a serious, yet widespread type of research misconduct, and is often neglected in developing countries. Despite its far-reaching implications, plagiarism is poorly acknowledged and discussed in the academic setting, and insufficient evidence exists in Latin America and developing countries to inform the development of preventive strategies. In this context, we present a longitudinal case study of seven instances of plagiarism and cheating arising in four consecutive classes of an Epidemiology Masters program in Lima, Peru, and describes the implementation (...) and outcomes of a multifaceted, “zero-tolerance” policy aimed at introducing research integrity. Two cases involved cheating in graded assignments, and five cases correspond to plagiarism in the thesis protocol. Cases revealed poor awareness of high tolerance to plagiarism, poor academic performance, and widespread writing deficiencies, compensated with patchwriting and copy-pasting. Depending on the events’ severity, penalties included course failure and separation from the program. Students at fault did not engage in further plagiarism. Between 2011 and 2013, the Masters program sequentially introduced a preventive policy consisting of: intensified research integrity and scientific writing education, a stepwise, cumulative writing process; honor codes; active search for plagiarism in all academic products; and a “zero-tolerance” policy in response to documented cases. No cases were detected in 2014. In conclusion, plagiarism seems to be widespread in resource-limited settings and a greater response with educational and zero-tolerance components is needed to prevent it. (shrink)

Experiencing ethics not only refers to being confronted with a situation in which one must choose a course of action; it also makes reference to giving a narrative account of the circumstances and chain of events leading to such crossroads. Between both there is a chasm, a space of indeterminacy into which R. Musil and L. Sterne delve with aesthetic means. Their poetics move in opposite directions, but by following them to their last critical consequences this study reveals a kindred (...) ethical stance. This interpretation sheds light on the ethics revolving around character construction by examining the constraints thwarting any attempt to complete a biographical account or convey a protagonist that led his or her life. Neither Musil nor Sterne posit a narrative agenda that could reach a last chapter or lead to a groundwork determining their ethics. A closer look into their tight-knit prose reveals that both rely on the narrating, on a skill that must be incessantly cultivated through a digressive or essayistic style. Equipped with a vast theoretical repertoire, this approach makes a strong case for a new constellation in comparative literature. (shrink)

In 1968, Aimé Césaire travelled to Cuba to participate in the Havana Cultural Congress, a mass international meeting where delegates discussed the place of culture in the struggle against imperialism, neo-colonialism, and underdevelopment. Among the likes of C.L.R. James, Nicolás Guillén, René Depestre, Michel Leiris, and Daniel Guérin, it was in Havana that the Martinican politician undertook the until-now untranslated interview with Sonia Aratán for the Casa de las Américas revue and delivered his Cultural Congress conference paper – previously believed (...) by Césaire scholars to be lost. Both texts shed light on Césaire’s little-known views on Fidel Castro, the Cuban Revolution and Marxism in the context of late-1960s tricontinentalism. By reconstructing Césaire’s exchanges with Cuban writers before and during the Congress, we propose a consideration of the role of Cuba in Césaire’s political thought as a tragic possibility, combining the catastrophe of Caribbean history with the uncertain potential of new social forms. In the seventh and most recent edition of their classic book, Principles of Biomedical Ethics, Tom Beauchamp and James Childress define a virtue as a character trait that is “socially valuable and reliably present” and a moral virtue as such a trait that is also both “dispositional” and “morally valuable”. The virtues that they single out as “focal” within biomedical ethics are compassion, discernment, trustworthiness, integrity, and conscientiousness. Not all is well in their treatment of virtue. Beauchamp and Childress seem (...) to worry that an ethical theory in which virtues are fundamental will neglect duties, rights, and societal needs. Further, they insist that there is no reason to think that, within ethical theory, one family of ethical concepts is the most important, nor that one theoretical approach is correct, or even superior to others. I will try to show, that there are strong reasons to see language, concepts, and matters of virtue as fundamental within normative ethical theory, both generally and in such specialized subareas as medical ethics. These reasons reveal themselves when we analyze concepts at the core of the alternative approaches to theorizing ethics that Beauchamp and Childress identify. (shrink)

Substantial advances in our understanding of the neural bases of emotional processing have been made over the past decades. Overall, studies in humans and other animals highlight the key role of the amygdala in the detection and evaluation of stimuli with affective value. Nonetheless, contradictory findings have been reported, especially in terms of the exact role of this structure in the processing of different emotions, giving rise to different neural models of emotion. For instance, although the amygdala has traditionally been (...) considered as exclusively involved in fear (and possibly anger), more recent work suggests that it may be important for processing other types of emotions, and even nonemotional information. A review of the main findings in this field is presented here, together with some of the hypotheses that have been put forward to interpret this literature and explain its inconsistencies. (shrink)

We report general and consensus results of a survey administered to a defined population of economic science academics in Mexico. Our results include insights on economic opinions, scientific aspects of economics, scientific activities, countries' economic performances and methodological orientation. Our outcomes show areas of consensus which, at least partially, are consistent with findings in previous studies. Comparisons between our results and those of other studies suggest that consensus could be constant over time and that economics academics in Mexico seems to (...) show similar levels of skepticism about the importance of rationality assumption as those in other latitudes. Racism as an independent topic of investigation in philosophy has considerably developed since the 1990s, when it appeared as part of growing debates that, on the one hand, investigated the political meaning of race and, on the other, its ontology and whether it existed at all. Likewise, with the idea of racism, its broadly normative meaning is critiqued by some philosophers, while others ask how best to conceive of it and identify its immorality. There were a few early and significant (...) forays in philosophy about the nature of racism, of which three works stand out because of the way they set the terms of the debate: David Theo Goldberg's Racist Culture, Charles W. Mills’ The Racial Contract, and Jorge L.A. Garcia's “The Heart of Racism.”1 This collection reacts to the latter fork in the discussion but does so in ways that significantly touch on the former.The collection begins with Jorge L. Garcia's “Virtue Ethics in Social Theory: Defending a Volitional Analysis of Racism from Tommie Shelby's Challenges.” It is a clarification and defense of his influential volitional analysis of racism (VAR) from three prominent objections: that VAR inadequately accounts for the immorality of racism because it relies on the assumed wrongness of racism built into ordinary usage of the term ‘racist;’ that it mistakenly separates intention from belief; and that it does not fully account for the racism of some troubling mental states that cannot be traced back to a racist ill-will. Garcia's account of racism as fundamentally rooted in racist ill-will, along with Lawrence Blum's, is representative of agent-centered theories of racism. Not only do they attempt to explain individual or personal racism, but they also hold that racism in institutions, structures, or systems traces back to the racism of persons.Current accounts of structural racism, however, claim that it exists and operates independently of infection from intentionally racist persons, that the focus on racist persons cannot adequately account for how racism works in society, and that, instead, we should concentrate on structures and ideologies. Amelia Wirts sharply defends this view in her, “What does it mean to say ‘The Criminal Justice System is Racist’?” She explains how structural racism applies to America's criminal justice system and other “intermediate” (between individual and societal level) structures. Wirts argues that personal accounts of racism, and in particular Garcia's VAR, do not adequately account for the patterns of racial disparity in the criminal justice system or its disproportionate harm to black people. She advocates, instead, for a patterned view of structural racism, the patterns of which operate “as if it were designed to disproportionately harm” some racialized group. Additionally, Wirts adds that such patterns are particularly racist when they fuel racist ideological symbols, as the criminal justice system does in relation to the idea of the black criminal.Structural analyses of racism are powerfully instructive, and Alisa Bierria, in “Structural Racism Within Reason,” offers an account that takes an epistemic turn that advances our understanding of their meaning. More than the idea that personal and structural racism beget each other in continuous looping effects, and more than the view that racism is best understood as an ideology that provides the content to racist attitudes or policy proscriptions, she argues that structural racism structures reason. Drawing on the 2012 case of Marissa Alexander, who unsuccessfully tried to use Florida's Stand Your Ground Law to justify her firing a warning shot at her estranged, abusive husband to protect herself from his murderous threat, Bierra argues that structural racism extends constructed and controlling intentions onto its targets, and, as in the case she discusses, it uses those constructed and fictional intentions to justify their punishment and depriving them of equal justice.Structural analyses of racism are essential additions to the philosophical understanding of racism that have appropriately challenged the centrality of agent-centered accounts. The increasing academic focus on structural explanations, however, along with the current overuse of “systemic racism” in popular discourse, threatens to eclipse the value of accounts of agent-centered accounts. In “Is Racism Essentially Systemic?” Michael Hardimon counsels against this trend. He reminds us that racism is not essentially systemic, and that the dominance of structural explanations could obscure its other forms and even the proper understanding of structural racism. Indeed, structures once constructed might operate independently of human intention, but they are designed, initiated, and often operated by persons.After considering the direction of the current philosophical discussion about the meaning of racism and its immorality, the next set of articles expands the discussion into matters of class, xenophobia, and white nationalism. Lawrence Blum's “Race and Class Together” starts it off. Blum builds class into his analysis of racism and critiques its absence in anti-racist theory. He argues that paying attention to class is required to secure justice for the victims of racism because pursuing justice is often a matter of both. Blum contends that race and class are “normatively distinct axes of injustice” and that, depending on the question, racial injustice needs to be addressed separately. However, there are aspects of racial injustice that can only be dealt with through a class analysis and require class or combined class–race focused policies. Pointing to the fact that many of the members of groups targeted by racism (he considers blacks, Indigenous peoples, and Latinxs) share cross-class interests, which includes shared interests with some whites, which they do not share with more economically privileged members of their own groups, Blum argues that these interests should be addressed through “class-focused policies,” in a manner that will secure justice for disadvantaged racial groups.Shifting from the class-race analysis, José Jorge Mendoza, in “‘Go Back to Where You Came From!’ Racism, Xenophobia, and White Nationalism,” turns our attention toward white nationalism to examine whether it is best understood as an expression of racism or xenophobia. Although he recognizes the importance of xenophobia in white nationalism, Mendoza does not neglect its connections with racist ideas. However, he acknowledges that emphasizing the role of race in condemnations of white nationalism risks overextending the concept of race, i.e., in regards to pan-racial groups, because some members of those groups are racially identified as white. Thus, the charge of racism against white nationalism in such cases may not clearly apply. To deal with those cases, Mendoza cleverly decouples the ideas of “radicalization” and “racial formation,” and he puts forward a new concept, “racial disintegration,” to account for the operation and shifting targets of white nationalism.In the final piece, David H. Kim and I discuss xenophobia and racism in the case of “Anti-Asian Racism.” We move from general theories of racism to inquire about what is at the base of anti-Asian racism. Little is said in contemporary accounts of racism about anti-Asian racism. This is due, in part, to the high level of abstraction in those discussions but also because much of the literature takes anti-blackness as the model of racism. Our piece addresses this lacuna in a manner not beholden to the black-white binary. We discuss how the idea of anti-Asian racism is a conceptual problem in the American context dominated by that binary. We then argue that xenophobia as a form of civic ostracism, and to some extent xenophilia, play a particular role in how anti-Asian racism functions and its immorality.The pieces in this collection resonate with current events and controversies involving racism and illustrate the potential of the debate to relate to and speak those events, not just to the specialized interests of a cloistered academic conversation. Each piece demonstrates the potential for extending vital lines of debate and discussion that touches the raw nerve of the public discussion of racism. (shrink)

Les Critical Legal Studies et ses divers tributaires ont fortement marqué la conscience juridique contemporaine. Ces notions ne sont plus simplement le domaine d’un collectif de juristes nord-américains, mais font désormais partie du discours académique transnational et influencent la formation de divers projets et demandes politiques, malgré leur impact négligeable sur la pratique juridique traditionnelle. Les mouvements de type féministe, racial, LGBTQ+ et postcolonialiste ont profité largement de l’énergie intellectuelle et de l’engagement inhérent à ses analyses critiques. En outre, ces (...) façons d’envisager le droit et de faire de la politique trouvent leur écho en plusieurs juridictions. Des manifestations parallèles, allant au-delà des États-Unis, mettent en évidence la portée de ces idées. A genuine bioethics would be fiercely devoted to human life (bios) and would express that devotion by articulating as well as advocating moral virtues that rigorously protect that value against the temptation to see life in purely instrumental terms. In my view, no genuine bioethics exists today. In what follows, I will question two fundamental assumptions often presumed in discussions of euthanasia and assisted suicide. These are (i) the agent does will her victim (i.e., her putative beneficiary) some significant human (...) good, e.g., relief from pain, escape from becoming a burden to loved ones, a dignified death, or simply self-determination; (ii) in purposely helping someone to kill herself or in killing her for her own good, the agent wills her no serious harm. Put differently, I question the assumption of ‘mercy’ in so-called ‘mercy-killing’. (shrink)

This paper examines the points of disagreement between Petrus Camper and J. W. von Goethe regarding the existence of the inter-maxillary bone in humans as the link between man and the rest of nature. This historical case illustrates the fundamental role of aesthetic judgements in scientific discovery. Thus, I shall show how the eighteenth century discovery of the inter-maxillary bone in humans was largely determined by aesthetic factors—specifically, those sets of assumptions and criteria implied in the aesthetic schemata of Camper (...) and Goethe. I argue that the relevance of scientifically ascertainable morphological properties that count as evidence for the existence of bona fide anatomical structures depend on the aesthetic schema adopted by the communities assessing the classification. At the same time, I propose and explain mechanisms by which aesthetic considerations might determine the acceptability of empirical claims about the world. Based on the reconstruction of the arguments of Camper and Goethe, I conclude that aesthetic considerations play a substantive role in both the generation and preliminary evaluation of scientific hypotheses. This paper suggests a complementary relation between the mediation of aesthetic criteria in theory choice and in scientific discovery in that while aesthetic considerations in theory choice lead to conservatism; in the context of discovery they often lead to innovation. Carlos Eduardo Alchourrón y Eugenio Bulygin efectuaron contribuciones de fundamental importancia para el desarrollo de la teoría de los sistemas jurídicos. Sus ideas evidencian una evolución de la presentación de una visión estática a una visión dinámica de tales sistemas. El objetivo central del presente trabajo consiste en mostrar que existe, no obstante, una cierta tensión en las tesis sostenidas por los autores entre dos concepciones diferentes de los sistemas jurídicos: por una parte, aquella que trata de reconstruir el conjunto (...) de las normas que resultan relevantes para la solución de un caso; por la otra, aquella que trata de ofrecer una caracterización satisfactoria del derecho como institución. Las diferentes finalidades que cada una de esas reconstrucciones persiguen obligan a refinar algunas ideas vinculadas con la dinámica del derecho para evitar derivaciones incompatibles con las intuiciones jurídicas ordinarias. Carlos Eduardo Alchourrón and Eugenio Bulygin have made contributions of fundamental importance for the development of the theory of legal systems. Their ideas reflex an evolution from a static to a dynamic vision of such systems. The main purpose of the present paper is to show that, notwithstanding, there exists a certain tension in the thesis defended by Alchourrón and Bulygin between two different conceptions of a legal system. On the one hand, a conception related to the reconstruction of the set of relevant norms to solve a certain case; on the other, a conception related to a satisfactory characterization of law as an institution. The different concerns of each of those reconstructions force to refine certain ideas associated with the dynamics of law to avoid derivations which appear incompatible with ordinary legal intuitions. Philosophers of experiment have acknowledged that experiments are often more than mere hypothesis-tests, once thought to be an experiment's exclusive calling. Drawing on examples from contemporary biology, I make an additional amendment to our understanding of experiment by examining the way that `wide' instrumentation can, for reasons of efficiency, lead scientists away from traditional hypothesis-directed methods of experimentation and towards exploratory methods.

A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Resumo O objetivo do texto é relacionar a abordagem expressivista do agente moral em Nietzsche com as condições de sucesso de avaliação de juízos práticos perfeccionistas. Como locus da transformação, o agente moral se exprime por meio do potencial transformativo que consegue produzir, e não como entidade por trás das ações. Duas condições podem ser usadas, regulativamente, para avaliar o sucesso de juízos de caráter perfeccionista: por um lado, a maximização de conexões e interrelações no espaço, bem como o endosso (...) afirmativo de promessas no tempo e, por outro lado, a boa constituição que alguém mantém em meio à tensão entre um plano individual e supraindividual. No desdobramento do potencial transformativo, crítica e transformação são interdependentes e, além disso, o julgamento público reforça a dimensão social da filosofia de Nietzsche.The aim of the text is to relate the expressivist approach of the moral agency in Nietzsche to the conditions for successful evaluation of practical perfectionist judgments. As the locus of transformation, the moral agent expresses him/herself in the transformative potential that he/she manages to produce, and not as an entity behind the actions. Two conditions can be used, regulatively, to evaluate the success of perfectionist judgments: on the one hand, the maximization of connections and interrelationships in space, as well as the affirmative endorsement of promises in time, and, on the other hand, the good constitution one keeps in the middle of the tension between an individual and supraindividual plan. In the unfolding of transformative potential, criticism and transformation are interdependent and, moreover, public judgment reinforces the social dimension of Nietzsche's philosophy. (shrink)

Philosophical discussions of species have focused on multicellular, sexual animals and have often neglected to consider unicellular organisms like bacteria. This article begins to fill this gap by considering what species concepts, if any, apply neatly to the bacterial world. First, I argue that the biological species concept cannot be applied to bacteria because of the variable rates of genetic transfer between populations, depending in part on which gene type is prioritized. Second, I present a critique of phylogenetic bacterial species, (...) arguing that phylogenetic bacterial classification requires a questionable metaphysical commitment to the existence of essential genes. I conclude by considering how microbiologists have dealt with these biological complexities by using more pragmatic and not exclusively evolutionary accounts of species. I argue that this pragmatism is not borne of laziness but rather of the substantial conceptual problems in classifying bacteria based on any evolutionary standard. (shrink)
